PRE-CONTRACT PROTECTION
TERMS & CONDITIONS

1. The Service

By purchasing the Pre-Contract Protection service, you engage New Build Advisory to provide independent building advisory and support services during the pre-contract stage of your residential building project.

The service is intended to assist you in understanding and navigating matters such as builder communications, preliminary designs, quotations, inclusions, allowances, site costs, specifications, proposed contract terms and the general pre-construction process.

2. Service Period

The initial service fee of $495 AUD provides support for a period of 90 days from the date of purchase.

If further support is required after the initial 90-day period, additional 30-day support periods may be purchased for $195 AUD per 30 days.

Unused days or support periods cannot be transferred to another project or client.

3. What's Included

During the service period, New Build Advisory may provide:

  • Email support relating to your proposed build

  • Guidance regarding plans, quotations and inclusions

  • Assistance identifying potential omissions, allowances or areas requiring clarification

  • General guidance regarding site costs and pre-construction matters

  • Assistance understanding builder communications

  • General review of proposed building documentation

  • Guidance on questions you may wish to raise with your builder

  • Independent support during the pre-contract decision-making process

The service does not include unlimited meetings or telephone/video consultations unless specifically agreed. Additional consultation services may incur a separate fee.

4. Nature of Our Advice

New Build Advisory provides general building advisory and consultancy services based on industry knowledge and experience.

We are not your builder, building certifier, engineer, architect, building designer, quantity surveyor, solicitor, accountant or financial adviser.

Our review of plans, quotations, contracts or other documentation does not constitute legal, engineering, structural, financial or certification advice.

Where specialist advice is required, you should obtain advice from an appropriately qualified professional.

5. Builder Contracts

Any residential building contract is entered into directly between you and your chosen builder.

New Build Advisory is not a party to that contract and does not control the builder's pricing, construction methods, timeframes, variations, site costs, contractual obligations or performance.

You remain responsible for reviewing and approving all documentation before signing or making payments to a builder.

We strongly recommend obtaining independent legal advice before signing a building contract where appropriate.

6. Pricing, Quotes and Site Costs

Building prices, site costs, allowances, provisional sums and quotations can change as further information becomes available.

While we may identify items that warrant further investigation, New Build Advisory does not guarantee the accuracy or completeness of pricing supplied by builders, consultants, trades or other third parties.

Final pricing remains the responsibility of the builder or relevant service provider.

7. Client Responsibilities

To enable us to provide the service effectively, you agree to provide complete and accurate information and relevant documents in a reasonable timeframe.

You remain responsible for all final decisions relating to your builder, design, specifications, budget, contract and construction project.

8. No Guarantee of Outcome

Our role is to provide guidance and help you make more informed decisions.

We cannot guarantee that a building project will proceed without delays, variations, additional costs, disputes, builder insolvency or other unforeseen circumstances.

9. Fees and Refunds

The $495 service fee is payable in advance.

Because New Build Advisory reserves capacity and may commence reviewing your project immediately following purchase, refunds are not provided merely because you change your mind or decide not to proceed with your proposed build.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law that cannot lawfully be excluded.

10. Confidentiality

Information and documents provided by you will be treated as confidential and used for the purpose of providing the requested advisory services, subject to any disclosure required by law or reasonably required to provide the service.

11. Third-Party Information

New Build Advisory may rely upon information supplied by builders, developers, consultants, government authorities and other third parties.

We do not warrant that third-party information is complete, accurate or current and are not responsible for errors or omissions originating from those third parties.

12. Limitation of Service

Our advice is based on the information available to us at the time.

New Build Advisory is not responsible for matters that could not reasonably have been identified from the information provided to us or for decisions made contrary to our advice.

Nothing in these terms limits liability where it cannot legally be limited under Australian law.

13. Acceptance

By purchasing the Pre-Contract Protection service, you confirm that you have read, understood and agreed to these Terms & Conditions.
